Privacy & your data
This Privacy Policy explains how Financial Health Check (“we”, “us”, “our”), operated by financialhealthcheck.com.au Pty Limited, ABN 37 698 988 331, collects, uses, holds, discloses and protects your personal information. We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
By using this website and completing the financial health check, you agree to the collection and use of your information as described here.
1. The information we collect
We collect personal and business information that you choose to provide, and limited technical information collected automatically:
Information you give us — your name, business name, email address, phone number and state; the answers you provide in the check (including your responses about cash flow, tax position, margins, creditor and debtor pressure, and director circumstances); and any message you send us through the contact form.
Sensitive context. Some answers may reveal financial difficulty or personal financial stress. We treat this information with care and use it only for the purposes set out below.
Technical information — when you visit, our hosting and any analytics tools may record information such as your IP address, browser type, device, pages visited and the date and time of access. See section 7 (Cookies).
2. How we collect it
We collect information directly from you when you complete the check, submit the lead or contact form, or email us. We collect technical information automatically through our website infrastructure and cookies. We do not buy personal information or collect it from third parties without your knowledge.
3. Why we collect and use it
We collect and use your information to:
• generate your health score and report and make it available to you;
• email your report and respond to your enquiries;
• where you have asked us to, arrange introductions to professionals relevant to the services you selected;
• improve the check, our content and the website;
• meet our legal, regulatory and record-keeping obligations.
The check is an automated general-information tool. It does not make decisions that have a legal or similarly significant effect on you; any decision about your business remains yours, ideally taken with professional advice.
4. Consent
You can complete the check without giving us your contact details. We only collect your contact information and act on it where you submit it and tick the consent box. You may withdraw your consent or ask us to stop contacting you at any time by emailing privacy@financialhealthcheck.com.au.
5. Disclosure — including referrals
We do not sell your personal information. We may disclose it to:
• Professionals in our referral network — only where you have asked to be introduced to a particular type of professional (for example a finance broker, accountant, solicitor, debtor-collection specialist, virtual CFO, or an insolvency or restructuring professional). We share only what is reasonably necessary to make the introduction.
• Service providers who help us operate the website and communications (for example hosting, database and email delivery providers), who are bound to protect your information.
• Authorities or others where required or authorised by law.
Referral arrangements and independence. Some referrals may be to professionals or practices with which we have a commercial relationship, and some may involve a referral fee. One of the practices to which you may be referred is the insolvency practice associated with the operator of this website, who is a Registered Liquidator. You are under no obligation to use any professional we suggest and are free to choose your own adviser. Where a referral fee or a relationship affecting independence applies, it will be disclosed to you at the time of the introduction.
6. Overseas disclosure
Our website, database and email services are provided by reputable technology providers who may store or process data on servers located outside Australia. Where this occurs, we take reasonable steps to ensure your information is handled consistently with the APPs.
7. Cookies and analytics
We use cookies and similar technologies. Essential cookies are needed for the site to function and to remember your cookie choice. Analytics cookies, if enabled, help us understand how the site is used so we can improve it. When you first visit, you can accept or decline non-essential cookies through the banner. You can also clear or block cookies in your browser settings, though parts of the site may not work as intended.
8. Data security
We take reasonable steps to protect your information from misuse, loss and unauthorised access, including access controls and encryption in transit. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
9. How long we keep it
We keep your information only as long as needed for the purposes above and to meet our legal and record-keeping obligations, after which we take reasonable steps to delete or de-identify it.
10. Accessing and correcting your information
You can ask us to access, correct or delete the personal information we hold about you. Email privacy@financialhealthcheck.com.au and we will respond within a reasonable time. We may need to verify your identity first.
11. Complaints
If you have a privacy concern, contact us first at privacy@financialhealthcheck.com.au and we will aim to acknowledge it promptly and respond within 30 days. If you are not satisfied, you may contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
